Are old surveillance signs still valid?

The old signs in circulation refer to Article 13 of Legislative Decree 196/2003, which was repealed by Legislative Decree 101/2018.

It is therefore necessary to replace such signs or correct them by applying a new wording, such as: “Decision on video surveillance April 8, 2010 and Reg. EU 2016/679 GDPR“.

Video Surveillance Area and Information

Information to the individuals being recorded is ALWAYS required.
The Data Protection Authority and the guidelines state that the information must follow a multi-level approach.

A first piece of information aimed at ensuring immediacy is represented by the mentioned signs, which should be clearly visible immediately before the person enters the video-surveillance area.
If the camera can also record at night, the sign must be visible at night as well.

The Italian Data Protection Authority, in the Decision on video surveillance, identified a simplified model of “minimum” information, indicating the name of the data controller, the pursued purpose (if the system allows remote monitoring of employees’ activities, the purpose must necessarily and exclusively fall into the trio: Workplace safety / Protection of company assets / Organizational and production needs) and including a pictogram (possibly diversified to specify whether the images are only viewed or also recorded).

At the European level, the guidelines require that the notice must:

  • identify the “data controller”
  • specify the purpose of surveillance
  • clearly state whether images are recorded or not
  • provide contact information and a link to the online surveillance notice (if available)
  • if an outdoor area is under surveillance, this should be clearly indicated.

A second, more detailed notice with all the information required by the regulation will be placed inside the perimeter (inside the building, at the reception, at the concierge desk…).
