Are foreign vehicles subject to this obligation? Yes. Note that if they already display, on the sides and rear, a device intended to indicate the presence of blind spots in application of the legislation of another EU Member State, they are considered compliant.
Where should the signage be placed? The signage must be positioned so that it is visible in all circumstances and in such a way that it does not obstruct the visibility of the license plates and regulatory markings of the vehicle, the visibility of the various lights and signaling devices, or the driver's field of vision.
Are there regulatory requirements for the positioning of the signage? Yes. The signage must respect a very specific position provided for by Article 2 of the draft decree.
From next January 1st all heavy vehicles, including buses, circulating within French territory, must install labels (stickers or plates) in the areas considered blind spots for the driver.
On January 1st, 2021, in France, the decree regarding the application of Article R.313-32-1 of the Highway Code concerning the signaling of blind spots on heavy vehicles will come into force. Any vehicle subject to this decree must display the new signage; otherwise, the relevant authorities in France may sanction drivers and carriers.
This decree applies to:
- drivers and owners of heavy vehicles whose total authorized loaded weight exceeds 3.5 tons;
- buses and articulated buses.
Drivers, heavy vehicle owners, vulnerable users (particularly cyclists, pedestrians, users of individual means of transport), and supervisory authorities are the categories of people concerned by this decree.
